Big Pictury license models

If the customer has purchased visual media, he has the right to use them within the framework of the license model he has chosen. The licensee is always exclusively the client who is also listed as the licensee in the medium. The license models of the individual products or media are described below. Please note that the excerpt from our General Terms & Conditions at the end of this page with the general regulation of the rights of use, is the basis for all license models.

1. Web Picture

The Big Picture is supplied in screen resolution after completion and is available for digital use only. The resolution is usually 4,535×2,551 pixels at 72 dpi. Please refer to the respective product description for further details. The Big Picture can be used in presentations, on websites, intranets, online whiteboards and video conferencing programs, and as a presentation tool on small and large screens. It can also be used in more advanced digital applications such as the integration into e-learning programs. Sections of the image may only be used in conjunction with the entire Big Picture to highlight areas of the Big Picture within the context of its application. For example, in the context of a presentation, an overview of the topic can be given on one page with the Big Picture, with sections of the image being shown on subsequent pages to communicate the sub-topics. The sections may not be used independently of the actual Big Picture to communicate other topics. The editing of the Big Picture, or sections of it, such as the modification of the illustration, is not permitted.

2. Print Picture

The Big Picture will be supplied in print resolution after completion. The file is optimised for printing, usually in the format: 200 x 112.5 cm at 300 dpi. Please refer to the respective product description for further details. This gives the customer the possibility to use the Big Picture in printed media. It can either be printed or applied directly, e.g. as a poster, wallpaper, whiteboard folio, etc., or it can be integrated into print media, e.g. in a staff magazine, brochure or flyer. The editing of the Big Picture, such as the modification of the illustration, is not permitted.

3. Click Picture und Video Picture

Both media are self-contained HTML5 programs that are used in the Internet browser. The use is possible in all areas in which Internet browsers are used, such as on the Internet, on the intranet or used on monitors, for example, at trade fairs, workshops, presentations, training events, etc. The editing of the Big Picture file, such as the modification of the illustration, is not permitted. Furthermore, the code supplied may not be changed or misused for other applications.

4. Manual

The manual is a ready-made medium for explaining the Big Picture as a Pdf, which can be used digitally or printed. Open print data for further processing are not included.

5. Digital Workshop-Set

a) General License Conditions Workshopset

What does the digital workshop set include?
The digital workshop set contains digital, visual elements that can be used digitally in workshops and events. The elements are provided as PNG files.

How and where can the workshop set and its individual elements be used?
Elements and components of the workshop set may only be used within the workshop or in the workshop announcement, or invitation and presentation of results. The elements may not be used independently of the workshop set in other contexts or media. For example, individual scenes from the set may not be used to visualize a topic on the intranet or internet that is not directly related to the workshop. The workshop group can freely use the digital elements of the workshop set within the workshop, e.g. placing included scenes on a background, adding text fields, duplicating elements, etc. The workshop set and its individual elements may be used by the customer for the purpose listed above in its programs and applications (e.g. in presentation programs or online whiteboards).

b) Individual License Terms
In addition to the general license conditions, the following applies to the individual license: In the case of an individual license, the license holder is the person who is verifiably named as the purchaser on the purchase invoice. The person must be part of the work with the set, e.g. as a trainer, workshop leader, moderator or consultant. The licensee must point out to participants in the workshop and users of the set that presentations of results (e.g. screenshots of a workshop result) may be taken to the workshop or workshop set for further communication and that the individual elements or the workshop set may not be used outside of the workshop (e.g. in other workshops ) is not permitted. Selling the individual elements or the workshop set is also not permitted (see general license conditions).

c) Enterprise License Terms
In addition to or deviating from the general license conditions, the following applies to the company license: With the company license, the workshop set can be made available for use by several participants, e.g. several trainers, executives or teams, depending on the agreement made. Resale, e.g. in connection with your own workshop offer, is also possible, and the set can be adapted and expanded to include company-specific elements such as company buildings and products, as well as the implementation of corporate design guidelines. The exact scope is agreed in the product description or in an individually tailored offer and verifiably recorded in the invoice.

6. Extract from General Terms & Conditions, Rights of use

The regulation of the rights of use is the basis for all of the aforementioned license models. In this respect, the customer acquires a non-exclusive, non-transferable, otherwise temporally and spatially unrestricted right of use to the visual media. With regard to this, in particular the rights defined in the UrhG (German Copyright Act) are granted for use in physical form (reproduction, distribution, exhibition) as well as in non-physical form (right of presentation, making available to the public). Further rights of use require our express permission.

In particular, the right of use granted does not cover the following forms of use:
• the sale or distribution of the acquired visual media
• the sale or distribution of products/goods produced by means of the visual media (e.g. as posters, digital prints, music tracks or physical products)
• the editing and modification of the visual media
• the sale or distribution of edited or modified visual media or of products/goods produced by means of the edited or modified visual media.

8.2 Subject to any legal restrictions (e.g. copyright), the provisions of Section 8.1 shall apply not only to the visual media as a whole, but also to all individual components thereof, unless the component does not benefit from any copyright or other legal protection (e.g. ancillary copyright) in itself.

8.3 The rights of use listed under Section 8.1 shall be subject to the condition precedent of full payment of the payment claims arising from the respective contractual relationship.

7. Deviations possible

Deviations from the license models are possible by arrangement, for example if you would like to resell your visual medium for a fee as part of your service or product. In this case, or if you have any further questions, please contact us at contact@big-pictury.com
